Two suspects, Thabo Bester and Doctor Nandipha Magudumana, who were arrested last month, are facing at least 12 charges. However, none of the charges they face pertain to murder, despite the fact that they were initially charged with murder after a corpse was found in Bester’s cell. The corpse was identified as that of 30-year-old Katlego Bereng Mpholo, who had gone missing in April of the previous year, a month before Bester’s escape from prison. The fact that the murder charge was withdrawn by the National Prosecuting Authority (NPA) has raised questions as to why this was done.

The two accused now face a graft of charges ranging from fraud, corruption, arson, the violation of a body, and defeating the ends of justice. The charge sheet details a total of 16 counts pertaining to Bester, Magudumana, Sekeleni (Magudumana’s father), and five former G4S employees. Last month, the NPA withdrew the charge of murder against Sekeleni before he was awarded bail. The victim’s family was shocked to learn that the murder charge was not included on the official charge sheet, and they are concerned that justice may not be served in this case.

Mpholo’s body was unlawfully claimed from a mortuary and smuggled into Bester’s cell before being set alight. The victim’s family is understandably distraught by the situation, and a member of the family expressed shock at the fact that the murder charge was not included on the charge sheet.Mpholo will be laid to rest in Bloemfontein on Sunday, and a memorial service will be held in his honor on Thursday afternoon.

This case highlights some of the challenges facing the South African criminal justice system. The withdrawal of the murder charge against the suspects raises concerns about the effectiveness of the justice system and its ability to hold criminals accountable for their actions. It also raises questions about the integrity of the NPA and its ability to carry out its duties effectively.

The fact that Mpholo’s body was unlawfully claimed from a mortuary and smuggled into Bester’s cell is a disturbing indication of the level of corruption that exists within the system. The charges of fraud, corruption, and defeating the ends of justice, which the suspects now face, suggest that there may have been some collusion between the accused and individuals within the criminal justice system.

This case is a reminder that the South African criminal justice system is still in need of significant reform. There is a need for greater transparency, accountability, and integrity within the system. The government and relevant authorities must take steps to address the underlying issues that allow corruption and other forms of criminality to thrive.
